1. Website ownership

Hereinafter, “Vista de Oro”.

2. Purpose and acceptance

These Terms govern access to and use of the website www.vistadeorocr.com and the information and contact services available on it.

Accessing the site implies full acceptance of these Terms. Anyone who does not agree with them should refrain from using it.

3. Informational nature of the site

The content of this site is informational and promotional.

The information published, including descriptions of facilities, services, accommodation options, care programs and reference rates, is not a binding contractual offer, a reservation or a commitment to provide services.

Any contractual relationship between Vista de Oro and an interested person is formalized exclusively through documents signed by both parties, following the admission process.

4. Project under development

At the time these Terms are published, the residence is under construction. Therefore:

• The images, renderings and graphic representations published on the site are illustrative architectural projections. They are an approximate representation of the project and may differ from the final built result in finishes, furniture, layout, vegetation, lighting and other elements.
• The opening dates shown are estimates and are subject to construction progress, the granting of the corresponding permits and factors beyond Vista de Oro’s control. Changes to them do not create any liability.
• The descriptions of services, programs and professional team correspond to the model planned for the residence’s operation and will be implemented progressively as it begins operating.
• The project is being developed in accordance with applicable technical and health requirements. Permits, authorizations and licenses are being processed with the competent authorities as construction progresses.

5. Interest list

The interest list form available on the site allows interested people to receive priority information about the opening, availability, accommodation options, services, rates and visit dates.

The interest list:

• Is free of charge.
• Is not a reservation or a hold on a space.
• Does not ensure or guarantee the availability of a place at the residence.
• Creates no obligation for the person registering or for Vista de Oro.

Admission to the residence is subject in all cases to the admission process and the corresponding individual assessment.

A formal reservation process may be made available later, and its terms will be communicated expressly at that time.

6. Reference rates

When the site shows a reference value, it corresponds to the accommodation type indicated and is expressed in United States dollars.

The final rate for each resident depends on the accommodation type selected, the individual assessment and the level of care required, and is communicated individually during the admission process.

Published values are for reference only and may change without notice.

7. No care relationship or medical advice

Vista de Oro Senior Living is a residence for older adults. It is not a hospital, a clinic or a medical care center.

The content of this site does not constitute medical advice, diagnosis or recommendation, and does not replace consultation with health professionals. Browsing the site or submitting a form does not create any care relationship between Vista de Oro and the user.

No information published should be interpreted as a promise of clinical or therapeutic results.

8. Permitted use

Users agree to use the site in accordance with the law, good faith and these Terms. The following is prohibited:

• Using the site for unlawful purposes or in ways that harm the rights of third parties.
• Introducing or spreading malicious code, or taking actions that damage, overload or prevent the normal operation of the site.
• Systematically extracting, reproducing or reusing the site’s content through automated means.
• Providing false information, or third-party information without authorization, through the forms.

9. Intellectual property

The site’s content, including texts, images, renderings, photographs, design, distinctive signs, logos and other elements, is owned by Vista de Oro or by third parties who have authorized its use, and is protected by Costa Rican copyright and industrial property law.

Viewing and reproduction for personal, non-commercial use is permitted. Any other use requires prior written authorization.

10. Links to third-party sites

The site may include links to third-party websites, offered solely for the user’s convenience. Vista de Oro does not control those sites and assumes no responsibility for their content, practices or policies.

11. Site availability

Vista de Oro strives to keep the site available and up to date, but does not guarantee uninterrupted or error-free operation. It may temporarily suspend access for maintenance, security or reasons beyond its control, without incurring any liability.

12. Limitation of liability

To the extent permitted by Costa Rican law, Vista de Oro is not liable for:

• Damages arising from the use of the site or the inability to use it.
• Decisions made solely on the basis of the information published on the site, without going through the corresponding inquiry and admission process.
• Connectivity failures, failures of the user’s equipment or of services provided by third parties.

This section is without prejudice to the inalienable rights that Costa Rican Law No. 7472, Law for the Promotion of Competition and Effective Consumer Protection, grants to consumers.

13. Personal data protection

The processing of personal data collected through the site is governed by the Privacy Policy and the Cookie Policy, which form an integral part of these Terms.

14. Changes

Vista de Oro may modify these Terms at any time. The current version is the one published on the site, with its effective date. We recommend reviewing them periodically.

15. Severability

If any provision of these Terms is declared void or unenforceable, the remaining provisions will remain in full force.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Costa Rica. Any dispute arising from their interpretation or application is subject to the jurisdiction of the Costa Rican courts, without prejudice to any applicable consumer protection administrative proceedings.
